PSC Urges Pinnacle Hip MDL Court to Conduct Staggered Remand of N.Y., Calif. Cases

DALLAS — The Plaintiffs’ Steering Committee in the DePuy Pinnacle hip MDL is urging the court to proceed with staggered remands of cases filed by plaintiffs from New York and California, arguing that the court should continue to preside over those remanded cases.

Defendants DePuy and Johnson & Johnson oppose the request, however, arguing that a complete remand is warranted because pretrial proceedings are at an end, and there is no justification for allowing plaintiffs or the court to select a limited category of cases to be remanded.
