S.C. Federal Judge Allows Hernia Mesh Claims to Proceed in 1 of 2 Cases

STATESVILLE, N.C. — A North Carolina federal judge has refused to dismiss a plaintiff’s claims that she was injured by a defective Composix Kugel hernia patch, finding her claims are timely because she was likely not aware of the cause of her injuries until 2015.
However, in the Aug. 3 order, Judge Richard L. Voorhees dismissed the claims of a second plaintiff for lack of personal jurisdiction, ruling that defendants Davol Inc. and C.R. Bard Inc. do not have such “exceptional” ties to North Carolina that they should be considered “essentially at home” in that state.
