N.J. Appellate Court Reinstates More Than 2,000 Accutane Cases, Says Expert Testimony Admissible

CAMDEN, N.J. — A New Jersey appellate court has reinstated 2,076 Accutane cases against Hoffman-La Roche Inc. and Roche Laboratories Inc., ruling that the methodologies used by the plaintiffs’ two causation experts were scientifically acceptable and therefore the trial court should not have barred their testimony.
In a July 28 opinion, the New Jersey Appellate Division found plaintiffs’ experts, Drs. David Madigan and Arthur Kornbluth “considered all of the relevant data and information, applied appropriate methodology in analyzing the epidemiological studies, and expressed valid reasons for rejecting the conclusions of some of the epidemiological studies and in accepting other studies …
