INDIANAPOLIS — Biomet Inc. has moved for summary judgment in the M2a Magnum MDL on the issues of whether the design, testing and warnings of the hip replacement system complied with the state of the art in the orthopedic industry.
In a July 18 filing in the U.S. District Court for the Northern District of Indiana, Biomet argued that it should not be held liable based on the medical community and regulators’ current views of the potential risks posed by metal-on-metal (MoM) hip implants, when those views were not accepted until 2008 or 2009 at the earliest.
