TOLEDO, Ohio — An Ohio federal judge has refused to reconsider his dismissal of a lawsuit concerning the SynchroMed II pain pump, finding the plaintiff failed to present “newly discovered evidence” that Medtronic violated manufacturing standards and the device’s Premarket Approval.
In a July 21 order, Senior Judge James Carr of the U.S. District Court for the Northern District of Ohio said the plaintiff failed to demonstrate that the “newly discovered” evidence was previously available to him.
