WILMINGTON, Del. — A Delaware judge has refused to dismiss a Pradaxa lawsuit, finding the plaintiff adequately pled that the drug’s manufacturers failed to warn of the lack of a reversal agent and of the increased risk of gastrointestinal bleeding.
On June 29, Judge Eric M. Davis of the Delaware Superior Court further ruled that the record is too underdeveloped for a determination of whether the learned intermediary doctrine shields defendants from liability.
