Levaquin Makers Had Duty to Disclose Safety Information to Plaintiffs, Ill. Federal Judge Rules

CHICAGO — An Illinois federal judge has allowed a fraudulent concealment claim to proceed against the makers of Levaquin, finding “common sense” dictates that they had a duty to disclose the drug’s safety information to the plaintiffs.

In the May 31 order Judge Gary Feinerman dismissed without prejudice the plaintiffs’ fraud claim, however, ruling that it was not pled with the particularity required by Rule 9(b).

Levaquin, manufactured by Janssen Pharmaceuticals Inc., is an antibiotic in the fluoroquinolone family.
