MOBILE, Ala. - The manufacturer of Vioxx and its sales representatives allegedly employed aggressive marketing tactics that concealed and misrepresented the dangers associated with the arthritis drug, states an Alabama woman's lawsuit. Carolyn Younge v. Merck & Co., et al., No. 03-0125-MJ-M (S.D. Ala.).
Plaintiff Carolyn Younge seeks to recover monetary damages for the personal injuries and wrongful death of her husband and for loss of consortium. Younge is also seeking punitive damages based on the company's 'conscious disregard of the foreseeable harm caused by Vioxx.'
