Ill. Court Awards Summary Judgment to Smith & Nephew, Says R3 Claims Untimely

PEORIA, Ill. –– An Illinois federal court has awarded summary judgment to Smith & Nephew in a case involving its R3 Acetabular System, finding that the plaintiff knew, or reasonably should have known, about the potential claims four years before the complaint was filed.
In the May 22 order, the U.S. District Court for the Central District of Illinois found the plaintiff was informed that she was having problems with her hip replacement components as early as 2010.
