Pa. Federal Judge Dismisses Negligent Design, Manufacture Claims in Stryker Hip Case

PITTSBURGH — A Pennsylvania federal judge has dismissed negligent design and negligent manufacture claims in a Stryker hip replacement action, finding the plaintiff failed to identify the system component that was defectively designed and did not explain how the manufacture of the system fell below FDA-imposed standards.
On April 20, Judge Cathy Bissoon of the U.S. District Court for the Western District of Pennsylvania also dismissed any claims relating to the plaintiff’s second hip replacement surgery, noting that the prior versions of the complaint only challenged the implants used during the first surgery.
