Plaintiffs File Appellate Brief in Appeal of $502 Million Verdict, Say Defense Assignments of Error ‘Wildly Exaggerated’

NEW ORLEANS –– The plaintiffs who were awarded a total of $502 million at the conclusion of a trial involving DePuy’s Pinnacle Hip Implant have filed their opening brief in the appeal of the verdict, maintaining that the defendants’ complaints about the trial are “wildly exaggerated.”

In the March 31 brief filed in the 5th Circuit U.S. Court of Appeals, the plaintiffs further said that the MDL Court was correct in submitting the product-liability claims to the jury and that the plaintiffs had fully satisfied Texas design-defect requirements.
