Lack of Expert Testimony Defeats Claims in Teva IUD Lawsuit, Ind. Federal Judge Rules

EVANSVILLE, Ind. — An Indiana federal judge has awarded Teva North America summary judgment in an action involving its allegedly defective ParaGard intrauterine contraceptive device, ruling that the plaintiff’s failure to produce expert reports defeats her claims.

On April 11, Judge Richard L. Young of the U.S. District Court for the Southern District of New York explained that expert testimony is required to establish that the device proximately caused the plaintiff’s injuries.
