ASHLAND, Ky. — A Kentucky federal judge has refused to dismiss a lawsuit accusing the makers of Type 2 diabetes drug Jardiance of failing to warn of the risk of diabetic ketoacidosis, finding plaintiffs have sufficiently alleged their claims.
On March 31, Judge Henry Wilholt Jr. of the U.S. District Court for the Eastern District of Kentucky said that without the benefit of discovery, dismissal would be premature.
