Type 2 Drug Jardiance Lawsuit to Proceed in Kentucky Federal Court

ASHLAND, Ky. — A Kentucky federal judge has refused to dismiss a lawsuit accusing the makers of Type 2 diabetes drug Jardiance of failing to warn of the risk of diabetic ketoacidosis, finding plaintiffs have sufficiently alleged their claims.

On March 31, Judge Henry Wilholt Jr. of the U.S. District Court for the Eastern District of Kentucky said that without the benefit of discovery, dismissal would be premature.

Bonnie Darbro was prescribed Jardiance to treat her Type 2 diabetes on Oct. 14, 2014. Approximately 10 days after beginning the drug, she developed diabetic ketoacidosis, resulting in admission to the intensive …
