PPI Kidney Disease Lawsuit Timely, Adequately Pled, Mo. Federal Judge Rules

KANSAS CITY — A Missouri federal judge has denied a motion to dismiss a lawsuit accusing the makers of proton pump inhibitor drugs of failing to warn of the risk of kidney disease, ruling that the complaint was timely filed because the statute of limitations was tolled due to defendants’ alleged fraudulent concealment.

On March 22, Senior Judge Ortrie D. Smith of the U.S. District Court for the Western District of Missouri further found the plaintiff adequately pled his theories of failure to warn and fraud.
