NexGen Knee Implant MDL Court Awards Summary Judgment in ‘Track Two’ Cases; Says Plaintiffs Didn’t Respond to Dismissal Efforts

CHICAGO –– The court overseeing the national coordinated docket for NexGen Knee Implant litigation has awarded defendant Zimmer Inc. summary judgment in a number of “Track Two” cases, noting that the plaintiffs in those specific cases had not refuted the defendant’s position that expert report deadlines had passed.

The U.S. District Court for the Northern District of Illinois’ March 3 order applies to 137 of the cases in which plaintiffs have “failed to address the legal arguments and factual assertions in Zimmer’s motion….”
