Pa. Federal Judge Retains Jurisdiction Over 106 Invokana Actions

PHILADELPHIA — A Pennsylvania federal judge has refused to remand 106 Invokana cases, concluding that defendants’ removal was timely and that federal jurisdiction exists under the Class Action Fairness Act because plaintiffs seek consolidation of the cases solely for pretrial purposes.

In a Feb. 22 order, Judge Goldberg of the U.S. District Court for the Eastern District of Pennsylvania denied plaintiffs’ motion to remand the actions to state court.

One hundred and six separate lawsuits were filed in the Philadelphia County Court of Common Pleas against Johnson & Johnson and Janssen Pharmaceuticals, alleging injuries sustained as a result of ingesting …
