INDIANAPOLIS — An Indiana federal judge has awarded the maker of a hernia repair patch summary judgment in a wrongful death action, finding the plaintiffs failed to prove that the allegedly defective patch led to the decedent’s demise.
In a Feb. 23 order, Judge Larry J. McKinney of the U.S. District Court for the Southern District of Indiana also excluded the causation testimony of plaintiffs’ experts, finding they failed to set forth a reliable, scientific opinion as to how the patch caused the alleged injuries.
