BIRMINGHAM, Ala. — An Alabama federal judge has awarded Novartis Pharmaceuticals Corp. summary judgment in a Reclast femur fracture action on the basis that the plaintiff cannot proffer expert testimony as to general or specific causation.
In a Feb. 10 order, Judge Virginia Hopkins of the U.S. District Court for the Northern District of Alabama noted that in late January, the court excluded in full or in part the testimony of all five of the plaintiff’s experts and as such, evidence of causation is lacking.
