Mo. Federal Judge Remands Risperdal Action, Says Nondiverse Plaintiffs’ Claims Properly Joined

ST. LOUIS — A Missouri federal judge has remanded a multi-plaintiff Risperdal/Invega action, ruling that the non-diverse plaintiffs’ claims were not fraudulently joined because “common issues of law and fact” connect the claims.

In a Feb. 7 order, Judge Carol E. Jackson of the U.S. District Court for the Eastern District of Missouri explained that common issues of law and fact are likely to arise because all of the plaintiffs that they sustained injuries from the use of the drugs.
