N.J. High Court Reinstates $25 Million Verdict in Accutane Action, Says Lawsuit Timely Filed

TRENTON, N.J. — The New Jersey Supreme Court has reinstated a $25 million verdict in an Accutane case, ruling that New Jersey’s, rather than Alabama’s, statute of limitations applies and therefore the plaintiff was entitled to equitable tolling and his case was timely filed.

In a Jan. 24 opinion, the high court explained that that Section 142 of the Second Restatement of Conflicts of Law requires application of the New Jersey, rather than Alabama, statute of limitations because New Jersey has a more significant relationship to the parties.
