Maker of Cradle Cap Treatment Denied Summary Judgment in Florida Federal Court

FORT MYERS, Fla. — A Florida federal judge has denied the maker of a cradle cap treatment summary judgment, ruling that questions of fact remain as to whether the plaintiffs’ claims are time-barred under the state’s four-year statute of limitations.

On Jan. 20, Judge Mac R. McCoy of the U.S. District Court for the Middle District of Florida said it is unclear from the complaint whether the plaintiff was aware that the product caused her children’s injuries before July 8, 2012.
