Zimmer Supplements Motion for Summary Judgment, Cites Additional Cases in Which Expert Report Deadlines Have Lapsed

CHICAGO –– Zimmer Inc. has supplemented its pending motion for summary judgment, citing two additional cases in which expert report deadlines have passed, according to documents filed recently with the MDL Court.

In the Dec. 29 supplement filed in the U.S. District Court for the Northern District of Illinois, Zimmer said that plaintiffs Beverly Grose and Catherine Anderson have both failed to file expert reports within the prescribed deadline.

The supplement was filed in support of Zimmer’s motion for summary judgment filed late last year, in which the defendant argued that certain “Track Two” cases should be dismissed.
