4th Cir. Upholds $3.27 Million Verdict in Ethicon Gynecare TVT-O Transvaginal Mesh Action

CHARLESTON, W. Va. — A federal appeals court has upheld a $3.27 million verdict awarded to a couple in an Ethicon Gynecare TVT Obturator transvaginal mesh action, agreeing with the jury and the trial court that the device was defectively designed.

On Jan. 26, the 4th Circuit U.S. Court of Appeals found the plaintiffs offered sufficient evidence for a reasonable jury to find that Ethicon’s use of heavyweight polypropylene mesh in the TVT-O caused plaintiffs’ injuries.
