Zimmer Denied Summary Judgment in 3rd Bellwether NexGen Knee Implant Action

CHICAGO — An Illinois federal judge has denied Zimmer’s motion for summary judgment in a NexGen Knee Implant action after ruling that the plaintiff’s sole causation expert, Dr. Sonny Bal, may present his opinion that the manufacturer failed to adequately warn of device failure in morbidly obese patients.

In a Jan. 3 opinion, Judge Rebecca Pallmeyer of the U.S. District Court for the Northern District of Illinois concluded that questions of fact exist as to whether the warnings accompanying the NexGen device failed to convey the particular risks faced by patients with a body mass index of more than 35. …
