Mo. Federal Judge Remands Multi-Plaintiff Essure Action, Says Claims Not Fraudulently Joined

ST. LOUIS — A Missouri federal judge has remanded to state court an Essure injury action, ruling that the claims of the out-of-state plaintiffs were not fraudulently joined with those of the in-state plaintiffs because common issues of law and fact connect the claims.

In a Dec. 2 order, Judge Henry Autrey of the U.S. District Court for the Eastern District of Missouri further ruled that plaintiffs’ claims do not depend on the resolution of a substantial federal question and that the District Court’s exercise of jurisdiction will disrupt the balance between federal and state jurisdiction.
