DALLAS –– DePuy Orthopaedics Inc. has filed a motion for a mistrial regarding improper references to cancer and other systemic injuries, saying the references are “irrelevant, speculative and highly inflammatory evidence….”
In the Nov. 17 motion filed in the U.S. District Court for the Northern District of Texas, DePuy argued that evidence that the risk of developing any systemic illness as a result of metal-on-metal implant “is entirely speculative and unknown.”
