FORT MYERS, Fla. — A Florida federal judge has allowed a Lexiscan injury action to proceed, finding the plaintiff has adequately alleged that Astellas Pharma US Inc. failed to adequately warn his physician of the drug’s serious side effects, such as a heart attack.
In a Nov. 4 order, Senior Judge John E. Steele of the U.S. District Court for the Middle District of Florida further ruled the plaintiff sufficiently alleged that defendant McKesson Corp. distributed the drug without adequate warnings of serious side effects.
