PROVIDENCE, R.I. — A Rhode Island federal judge has denied Stryker’s motion to dismiss a lawsuit concerning its Trident Acetabular Hip Replacement System, finding the plaintiff adequately alleged the manufacturer knew or should have known of the device’s defective condition, yet negligently failed to remedy the defects.

On Oct. 31, Chief Judge William E. Smith of the U.S. District Court for the District of Rhode Island further held that the plaintiff sufficiently pled her claims of failure to warn and breach of express and implied warranties.
