LOS ANGELES — A California appellate court has upheld an award of summary judgment to the makers of a cryoablation device, ruling that the plaintiffs failed to prove that a defect in the device’s design or warnings caused a patient’s death following a cryoablation procedure.
In an Oct. 28 opinion, the California Court of Appeal, 2nd District, referred to the treating doctor’s testimony, in which he averred that he was aware of the device’s risks and would not have treated his patient differently had he been provided with a different warning.
