CHARLESTON, W. Va. — A West Virginia state court awarded Pfizer Inc. summary judgment in a Zoloft birth defect case after excluding the opinions of the plaintiffs’ sole specific causation expert.
In an Oct. 5 opinion, the West Virginia Mass Litigation Panel found that the expert was not qualified to perform a differential diagnosis and that his affidavit was inconsistent with his deposition testimony in response to questions about specific developmental delays and their causal factors.
