PHILADELPHIA — A federal appellate court has upheld an award of summary judgment to Zimmer in a hip implant lawsuit, finding the plaintiffs failed to provide evidentiary support for their negligent design and negligent failure to warn claims.
On Oct. 7, the 3rd Circuit U.S. Court of Appeals agreed with the trial court that the plaintiffs failed to show that a reasonable jury could find that any unreasonable act or omission by Zimmer caused their injuries.
