WASHINGTON, D.C. — Plaintiffs have asked the Judicial Panel on Multidistrict Litigation to create a federal docket for actions involving Atrium Medical Corp.’s allegedly defective C-Qur hernia repair mesh, arguing that the cases arise out of the same course of conduct and involve identical product liability claims.
In an Oct. 10 motion, plaintiffs assert that the District of New Hampshire is an appropriate forum for the 12 pending actions and any future-filed actions because six of the cases are pending in that district and Atrium is headquartered in Hudson, N.H.
