CHICAGO — An Illinois federal judge has refused to dismiss a class action accusing the maker of a fertility drug of failing to reimburse consumers for failed fertility treatments in which certain recalled lots of the drug that did not meet potency specifications were used.
On Sept. 27, Judge Amy J. St. Eve of the U.S. District Court for the Northern District of Illinois ruled that the plaintiffs have adequately pled claims of breach of express warranty, violation of consumer protection laws, and unjust enrichment.
