Ind. Lawsuit Involving Boston Scientific Implantable Pulse Device Survives Motion to Dismiss

SOUTH BEND, Ind. — An Indiana federal judge has denied Boston Scientific’s motion to dismiss a lawsuit involving its implantable pulse device, finding the plaintiffs have pled a plausible claim that the device was not manufactured in accordance with federal law.

On Sept. 26, Judge James Moody of the U.S. District Court for the Northern District of Illinois ruled that formal discovery is needed before plaintiffs can plead their claims with more detail, noting that much of the information required to do so is confidential.
