Orthopedic Surgeon Moves to Remand Case Against Stryker, Says His Claims Don’t Belong in MDL

MINNEAPOLIS –– An orthopedic surgeon has moved to remand his claims against Stryker for the company’s allegedly defective Rejuvenate artificial hip system, saying that his claims are not subject to the master settlement agreement and has been “sidelined in favor of [personal injury] claims typical to the MDL.”
In the Aug. 23 motion to remand filed in the U.S. District Court for the District of Minnesota, the doctor maintained that his claims never belonged in the multidistrict litigation since he performed surgical implantations and never received one.
