Cook Vena Cava Filter Case Stayed Pending Possible Transfer to Indiana MDL

RENO, Nev. — A Nevada federal magistrate judge has stayed a vena cava filter case pending the action’s possible transfer to the Cook Medical multidistrict litigation, ruling that in the interests of judicial economy, the plaintiff’s motion to remand should be decided by the MDL court if transfer occurs.
In a Sept. 9 order, Judge Cam Ferenbach of the U.S. District Court for the District of Nevada explained that the MDL court is competent to apply Nevada state law if and when it decides the motion to remand.
