NEW YORK — State law claims asserted by a woman who claims she was injured by Johnson & Johnson contact lenses are preempted by federal law because they seek to impose safety standards that would enlarge upon the Food and Drug Administration’s rigorous premarket approval process.
On Aug. 25, Judge Eric N. Vitaliano of the U.S. District Court for the Eastern District of New York further held that the plaintiff failed to establish a link between her injuries and the allegedly defective manufacture of the lenses.
