ATLANTA — Intuitive Surgical Inc. is urging a Georgia federal judge to dismiss a lawsuit alleging that its robotic surgical instruments used during heart surgeries discharged metal particles that lodged in the plaintiffs’ brains, arguing that the amended complaint is comprised of only vague, conclusory allegations.
In a Sept. 12 motion filed in the U.S. District Court for the Northern District of Georgia, Intuitive contends that plaintiffs failed to allege any actual physical injury caused by the instruments or how the instruments are defective.
