MONROE, La. — A Louisiana federal judge has denied a plaintiff’s motion for relief from summary judgment awarded to Medtronic in a cervical plate action, ruling that the plaintiff failed to exercise due diligence to obtain discovery of facts that might have led to a different outcome.
On Aug. 31, Judge Robert G. James of the U.S. District Court for the Western District of Louisiana noted the plaintiff failed to inquire as to why Medtronic failed to produce documentation, nor did he move to compel production of such documentation.
