Benicar MDL Judge Reverses Earlier Remand of Nondiverse Plaintiffs’ Claims

TRENTON, N.J. — The New Jersey federal judge overseeing the Benicar multidistrict litigation has reversed an earlier order in which he remanded the claims of 35 plaintiffs to Missouri state court, ordering them to file their claims individually.
On Aug. 29, Judge Robert B. Kugler of the U.S. District Court for the District of New Jersey granted a motion for reconsideration filed by defendants Daiichi Sankyo Inc. and Forest Laboratories LLC.
The instant action was filed by 79 plaintiffs in the St. Louis (Mo.) Circuit Court in June 2015, alleging injuries caused by ingestion the blood pressure drug Benicar. …
