Utah Federal Judge Awards Tysabri Makers Summary Judgment, Says Drug’s Warnings Were Adequate

SALT LAKE CITY — A Utah federal judge has awarded the makers of the multiple sclerosis drug Tysabri summary judgment on negligence claims, ruling that the drug’s labeling adequately warned of the risk of progressive multifocal leukoencephalopathy.
In an Aug. 5 order, Judge David Nuffer of the U.S. District Court for the District of Utah further held that the plaintiff failed to establish a causal connection between the alleged inadequate warnings and the injuries because he failed to provide an expert to testify about a more adequate label.
