MILWAUKEE, Wis. — A Wisconsin federal judge has awarded Smith & Nephew Inc. summary judgment in a case involving its Birmingham Hip Resurfacing implant, finding the plaintiffs failed to present expert testimony that the device was defective.
On Aug. 1, Judge James D. Peterson of the U.S. District Court for the Western District of Wisconsin noted that the plaintiffs did not present evidence or argument in support of their action. As such, the judge entered judgment in S&N’s favor and closed the case.
