PHILADELPHIA — A Pennsylvania federal judge has refused to exclude the testimony of a plaintiff’s causation expert in a Tylenol wrongful death action, ruling that he is qualified to opine on the issue of drug-induced liver injury and that his methodology is sound.
On July 26, Judge Lawrence Stengel of the U.S. District Court for the Eastern District of Pennsylvania allowed Dr. Timothy Davern to testify that liver injury can occur at the daily-recommended dose of acetaminophen.
