NEW HAVEN, Conn. — A Connecticut federal judge has dismissed an Essure lawsuit with prejudice, finding the plaintiff’s claims are either expressly or impliedly preempted by federal law, or fail to establish a connection between Bayer’s alleged wrongful acts and her injuries.
On July 26, Judge Jeffrey Meyer dismissed the plaintiff’s third amended complaint with prejudice, ruling that amendment at this point would be futile.
