LOS ANGELES –– A California appellate court has affirmed an $8.3 million verdict entered in a DePuy ASR XL hip implant case, ruling in part that the trial court correctly barred evidence that the U.S. Food & Drug Administration approved the device since such testimony was not relevant to the issue of whether the product was defective under Montana law.

In a July 21 opinion, the California 2nd District Court of Appeal, Division 7, also rejected defense challenges to the admissibility of experts testifying on behalf of the plaintiff and concluded that the multi-million dollar verdict “did not shock our …
