Plaintiffs Urge JPML to Create Federal Docket for Essure Birth Control Actions

WASHINGTON, D.C. — The plaintiffs in a number of Essure actions pending in Pennsylvania federal court have asked the U.S. Judicial Panel on Multidistrict Litigation to create a federal docket for the lawsuits, arguing that the underlying claims all arise from the same device, assert the same, or similar, claims, and cause the same, or similar, injuries.
In a July 21 joint motion, the plaintiffs urged the JPML to transfer the cases to the U.S. District Court for the Eastern District of Pennsylvania and assign Judge Gerald A. McHugh, who is currently overseeing three Essure cases, to manage the litigation. …
