30 Women File Essure Lawsuit Against Bayer in Mo. Federal Court; Defendant Moves to Dismiss

ST. LOUIS — Thirty women have sued Bayer, accusing it of failing to warn that its Essure permanent birth control device can lead to serious injuries, including pain, heavy bleeding, inflammation, and autoimmune issues, while misrepresenting that the device is safe and effective.

On July 7, Bayer removed the complaint, originally filed in the St. Louis Circuit Court, to the U.S. District Court for the Eastern District of Missouri. The drug maker has since moved to dismiss the action, asserting lack of personal jurisdiction, preemption, and failure to state a claim.
