Texas Federal Judge Reduces $502 Million Pinnacle Hip Verdict to $152 Million

DALLAS –– A Texas federal judge has reduced a $360 million exemplary damages award to five plaintiffs in a DePuy Orthopaedics Inc. Pinnacle Hip Implant action to $9,646,256, thereby cutting the total verdict from $502 million to about $151 million.
However, in the July 6 order, Judge Ed Kinkeade in the U.S. District Court for the Northern District of Texas let the compensatory damages awards stand, rejecting DePuy and Johnson & Johnson’s arguments that they were grossly disproportionate to the plaintiffs’ injuries.
On March 17, after 42 days of trial, a jury awarded $502 million total to five separate plaintiffs. …
