BUFFALO, N.Y. — A New York federal judge has dismissed a lawsuit asserted against St. Jude Medical Inc. in connection with its Durata cardiac defibrillator lead, ruling that the breach of express warranty claim is based on a faulty theory of liability.
In a June 30 order, Judge Michael Telesca of the U.S. District Court for the Western District of New York further held that the plaintiff failed to link an FDA warning letter to the lead’s alleged defect because the inspection that led to the warning letter took place more than two years after the plaintiff’s implantation surgery.
