Miss. Court Awards Summary Judgment to Zimmer in NexGen System Case

JACKSON, Miss. –– A Mississippi federal court has awarded summary judgment to Zimmer defendants named in a NexGen System case, finding that the plaintiff had failed to proffer any expert testimony to counter the defendants’ expert testimony that the implant was not defective.

In the June 16 opinion, the U.S. District Court for the Southern District of Mississippi said the plaintiff could not survive summary judgment without expert opinion that the components were defective.

Plaintiff Beatrice Chatman filed the underlying case, contending that she suffered personal and economic injuries as a result of Zimmer’s allegedly defective NexGen Knee implant.
